Apologies after health and safety case is adjourned

Fri, 24 Jul 2015

The family of a construction worker who was killed in 2013 have been told legal proceedings concerning a health and safety breach won’t be rushed.

55-year-old Douglas man Gareth Sowden died from crush injuries on May 1st whilst working on a sewerage treatment site in Kirk Michael.

Tuke and Bell Limited and JCK Limited have been charged with failing to discharge duty – Tuke and Bell has admitted the charge.

JCK entered a not guilty plea and will now stand trial - both companies will next appear before the Court of General Gaol Delivery on August 21st.

Deemster Montgomerie told the court today he appreciated the delay must be prolonging the family’s anguish but he wasn’t going to rush proceedings “for the sake of it”.
